Terms of Usage

This Agreement contains the complete terms and conditions which govern your subscription of Web hosting and other related services provided by FlashWebHost.com

Upon signing up for FlashWebHost.com services, all customers agree to comply with our Terms of Service. The spirit of this policy is to ensure our customers are using FlashWebHost's services with due regard to the rights of other Internet users and in conformity with the requirements of our network environment.

1. Illegal Use

Our hosting plan may be used for lawful purposes only. Transmission, storage or distribution of any information, data or material in violation of any applicable law or regulation, or that may directly facilitate the violation of any particular law or regulation, is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorisation; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or links include: pirated software,hacker programs or archives, Warez sites, MP3, and IRC bots.

2.Domain Names

FlashWebHost will take necessary steps to register domain names on behalf of the client when requested. However, clients are responsible for renewing their domain names. FlashWebHost does not take responsibility for failing to renew domain names. If your domain name was registered via our company, you must check and take appropriate actions to renew a domain that is about to expire. We do not handle renewals unless specifically asked for by sending a ticket to our helpdesk.

We will make every effort to register, transfer and/or renew your requested domain name. This is not a guarantee that your requested domain name is available for registration, transfer and/or renewal. Your domain name may go unregistered, untransferred and/or renewed, due to circumstances beyond our control, such as registry, software and other problems or outages, and will not be grounds for compensation of financial loss.

An order for domain name registration, transfer and/or renewal, does not guarantee domain name registration, transfer and/or renewal. Domain names will not be registered, transferred and/or renewed until payment is received. If requested domain name is paid for, to us and subsequently not registered, transferred and/or renewed by, the domain registration fee will be refunded.

3. Security

Violations of system or network security are prohibited and may result in criminal and civil liability.Examples include but are not limited to the following: unauthorised access, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user,host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

4.Server Resources

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to either pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade its service to a professional plan. WE shall be the sole arbiter of what is considered to be a high server usage level. Any web hosting account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.

5. Banned Scripts

We do not allow scripts that requires more than 8Mb of memory space, more than 30 CPU seconds, or use more than 5% of all available system resources at any time.

We do not allow to run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD, Any software that interfaces with an IRC (Internet Relay Chat) network.

We do not allow IRC, egg drop bots or anything of the sort on our network. IRC servers are subject to DOS Attacks The ports necessary to make IRC work are filtered. If you are caught running an IRC server inside our network your account will be terminated. This is a pretty common practice in the hosting market today.

We do not allow following scripts with known security issue. UltimateBBS (all versions), Ikonboard (all versions), IRC Egg Drops, Proxy Servers, nph-proxy, The Anonymizer, any soap mailers, CGI-telnet or script that opens a shell session with the server.

6.UCE (Unsolicited Commerce Email)

Zero Tolerance Spam Policy: We take a zero tolerance stance against sending of unsolicited e-mail, commonly known as spam. Any user who sends out spam will have their account terminated without notice, if reseller is sending spam, all his accounts will be suspended. We charge $100 for spaming instance as clean up charge.

7.Server Abuse

Any attempts to undermine or cause harm to our server or customer are strictly prohibited and any customers attempting this will be terminated with out notice.

8. Service Availability

We shall use our reasonable endeavors to make available to you at all times the Server and the Services but we shall not, in any event, be liable for interruptions of Service or down-time of the Server. No more than one log-in session under any one account may be used at any time by you.

9. Server Outages/Moves

If for any reason we have to move your account from one type of server from another we will make sure you have all of the features on the new server except we reserve the right to not provide the same scripting solutions or database solutions.

10. Termination

The failure by a customer to meet or follow any of the above Terms of Use or fail to pay any sums due to us is grounds for account deactivation. We will be the sole arbiter as to what constitutes a violation of the Terms of Use. We reserves the right to suspend/remove any account without prior notice.

Terms of Service

You are solely responsible for any and all User Content and any transactions or other activities conducted on or through User Websites. By posting or distributing User Content on or through the Services, you represent and warrant to us that (i) you have all the necessary rights to post or distribute such User Content, and (ii) your posting or distribution of such User Content does not infringe or violate the rights of any third party.
